New Mobile Phone Detection Cameras in Adelaide
South Australia has introduced advanced mobile phone detection cameras in various locations across the greater Adelaide region, designed to detect motorists using their mobile phones whist operating a motor vehicle. There has been a 3-month period of ‘grace’ where this offence has only attracted a warning notice. From 19 September 2024, motorists face penalties inclusive of a fine and 3 demerit points.
The existing cameras are established at the following locations:
- Southern Expressway, Darlington
- South Road, Torrensville
- North South Motorway, Regency Park
- Port Road, Hindmarsh
- Port Wakefield Road, Gepps Cross.
Note: these cameras will eventually be placed in more areas, we will try and update this list as we become aware of more mobile detection cameras.
How Do These Cameras Work?
The new cameras use sophisticated artificial intelligence technology that can apparently detect mobile phone usage inside a vehicle, including in conditions like poor weather or low visibility. These cameras capture high-resolution images of drivers, allowing the authorities to then review the photograph, and determine whether a mobile device is being used illegally.
Given the detection process is heavily contingent on artificial intelligence, there is scope for the accuracy and reliability of these cameras to be tested. We understand that similar cameras interstate have detected items like a wallet as a ‘phone’. It is therefore imperative that drivers review the photograph with scrutiny before accepting the penalties. If you have any concerns about the accuracy or reliability of the photograph, please seek legal advice.
The Legal Implications you may face
It is an offence to use a mobile phone whilst operating a motor vehicle pursuant to section 300 of the Australian Road Rules. Any detected offence will fall within these provisions. At the time of publishing this article, drivers are subject to a fine of $556 (not including levies) and three (3) demerit points if detected.
The 3 demerit points associated with this offence may see you breach the conditions of your licence (by incurring too many demerit points). If you believe this is applicable to you, it is important you seek legal advice prior to accepting the fine. There may be avenues in which we can guide you to retain your licence.
